  • OSHA Law

Safety is not Luck, it is a Managed Process.

Consistent with this belief is the legal duty that employers must provide a safe work environment for its employees. To that end, the Occupational Health and Safety Administration (OSHA) maintains its Top Ten most frequently violated standards in the workplace. Specifically, (1)Employees who operate powered industrial equipment (ForkLifts, Pallet Jacks and Reach Trucks),(2) Employees who are exposed to hazardous substances and/or hazardous wastes, and (3) Employees who should be provided adequate PPE (Personal Protective Equipment)based on the assessed hazards of their job, are at the greatest risk.

Many organizations invest in technology, equipment and systems that create efficiency, but not necessarily safety. And oftentimes, those who make the decisions do so on an expense to profit ratio. This analysis and subsequent decision making leads to safety being viewed as a line item (expense). They are wrong. “Safety is an investment, not just an expense.” Thinking to the contrary creates the environment for grave consequences. I have witnessed, investigated, reported and made recommendations on modern safety practices and compliance with the law. Likewise, I have witnessed, investigated, and reported on safety incidents which could have very easily been avoided.

If you have been injured at work, please (1) report the injury to your manager, (2) seek medical attention as soon possible, and (3) contact Robert Lewis Law. Time is of the Essence.

"There were 392 workplace homicides in 2020. There were also 37,060 nonfatal injuries in the workplace resulting from an intentional injury by another person." An employer has a legal duty to provide a safe workplace  for its employees.  Failure to do so, is a breach of that duty.
